These Terms of Service ("Terms") govern your use of the sakaynatech.com website and our software products — AccountingPro ERP, SakaynaTech Payroll, and the SariKita mobile app (together, the "Services"), operated by SakaynaTech IT Solutions OPC ("SakaynaTech", "we", "us"). By using our website or installing our software, you agree to these Terms. If you do not agree, please do not use the Services.
In plain terms: our software runs on your own device and your business data stays with you (see our Privacy Policy). You're responsible for your own data and backups. We provide the tools "as is" and do our best to support you, but we can't guarantee the software is perfect for every situation.
1. Who can use the Services
The Services are intended for businesses and individuals aged 18 and above. By using them you confirm you have the authority to accept these Terms on behalf of yourself or your business.
2. Our products & licenses
- AccountingPro ERP — licensed under a one-time payment per the plan you purchase. The license is for your business's use on your own computers/LAN.
- SakaynaTech Payroll — offered on a monthly subscription. Access continues for as long as your subscription is active.
- SariKita — currently a free early-access (beta) Android app distributed through Google Play closed testing. Features may change, and the app is provided for testing and feedback. SariKita is a store record-keeping app, not a BIR-accredited POS; receipts it generates are informal acknowledgments and are not BIR Official Receipts or Sales Invoices.
When you purchase a license, we issue you a license key for your own use. You may not resell, sublicense, share, or publish your license key, or attempt to circumvent licensing or usage limits.
3. Demos and trial mode
We offer free demos and an in-app Demo Mode with limited capacity so you can evaluate the software before buying. Demo Mode is for evaluation only and may restrict the number of users or records.
4. Payment
Payments are made directly via GCash or bank transfer and confirmed manually by us before a license key is issued. Prices are stated on our website and may change for future purchases. Because our products are digital and delivered immediately upon activation, all sales are generally final; if something goes wrong, contact us and we'll work with you in good faith.
5. Your data and your responsibilities
Data you encode in our software — employees, salaries, customers, sales, utang, and transactions — is stored on your own device, under your control. You are responsible for:
- Keeping your own backups using the built-in Backup & Restore feature;
- Protecting your device, license key, and any PIN or password you set;
- Complying with applicable law — including the Philippine Data Privacy Act of 2012 (RA 10173) — regarding your employees' and customers' information;
- The accuracy of figures you encode, and for verifying tax, payroll, and government computations against the official rules of the BIR, SSS, PhilHealth, Pag-IBIG, and DOLE.
Our software provides computational tools and is not a substitute for professional accounting, legal, or tax advice.
6. Acceptable use
You agree not to: reverse-engineer, decompile, or tamper with the software except as allowed by law; use the Services for any unlawful purpose; or interfere with the operation or security of our website and systems.
7. Intellectual property
The Services, including all software, designs, logos, and content, are owned by SakaynaTech IT Solutions OPC and protected by law. Your license grants you the right to use the software; it does not transfer ownership.
8. Availability and changes
We may update, improve, or change features of the Services over time. For early-access products like SariKita, features may be added, changed, or removed during testing. We aim to give reasonable notice of significant changes.
9. Disclaimer of warranties
The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or fit for a particular purpose.
10. Limitation of liability
To the maximum extent permitted by Philippine law, SakaynaTech IT Solutions OPC shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data or profits, arising from your use of (or inability to use) the Services. Our total liability for any claim shall not exceed the amount you paid us for the relevant product. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access if these Terms are violated. For subscriptions, access ends when the subscription lapses. Provisions on intellectual property, disclaimers, and liability survive termination.
12. Governing law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute shall be subject to the jurisdiction of the proper courts of General Santos City.
13. Changes to these Terms
We may update these Terms from time to time. We'll update this page and the effective date above; continued use of the Services after changes means you accept the revised Terms.
